1. WHO WE ARE

This is the Privacy Policy (“Privacy Policy”) of DE KERCOET, Inc. and each of its affiliates and subsidiary entities (“DE KERCOET,” “we,” “us,” or “our”). We operate the website located at https://www.dekercoet.com/  (the “Website”) through which we sell premium furniture and home furnishing products to consumers in the United States. The Website may ask for and collect your Personal Information (defined below) to facilitate sales, enhance your experience, and provide you with relevant information.

This Privacy Policy describes how we collect, use, disclose, and protect Personal Information about individuals who visit the Website, create an account, place an order, or otherwise interact with us (“you” or “consumer”). It also describes your privacy rights and how to exercise them. The term “Personal Information” refers to non-public information that personally relates to or identifies you (such as your name, password, age, gender, email address, postal mailing address, zip code, home/mobile telephone number, website pages viewed, and other similar information).

2. INFORMATION WE COLLECT

We collect Personal Information in the following categories. The chart below identifies each category, examples of information within that category, and the source from which it is collected.

2.1 Information You Provide Directly

  • Identifiers: Name, email address, postal/shipping address, telephone number, account username and password.
  • Purchase and Transaction Data: Order history, items purchased, order value, returns, and refund
  • history.
  • Payment Information: Credit or debit card details, billing address. Note: we do not store full card numbers. Payment processing is handled by a PCI-DSS-compliant third-party processor, and we receive only a payment token and last four digits of your card number.
  • Custom Order Specifications: Dimensions, design choices, and other specifications you submit for bespoke or made-to-order items, together with any images you send us in connection with a project — including photographs of the room or premises where the furniture is to be placed, inspiration images, and screenshots of our own catalogue or social media pages. We use these images solely to advise on, quote, produce and deliver your order, and we do not use them in our own marketing or publish them without your separate written consent. Embedded metadata (including EXIF geolocation data) is removed from images on receipt, and we do not use or retain precise geolocation data derived from images you send us.
  • Customer Communications: Records of emails, chat transcripts, support tickets, and phone call logs when you contact us.
  • Marketing Preferences: Whether you have opted in or out of marketing communications, and your stated preferences.

2.2 Information Collected Automatically

  • Device and Technical Data: IP address, browser type and version, operating system, device identifiers, screen resolution, and referring URL.
  • Usage Data: Pages viewed, links clicked, time spent on pages, search queries on our site, and navigation paths.
  • Cookie and Tracking Data: Data collected through cookies, pixel tags, web beacons, and similar technologies. See Section 8 (Cookies and Tracking Technologies) for full details.
  • Location Data: Approximate location derived from IP address. We do not collect precise GPS location without your explicit consent.

2.3 Information from Third Parties

  • Delivery Partners: Delivery confirmation, scheduling data, and damage reports from our logistics and white-glove delivery providers.
  • Payment Processors: Transaction status and fraud risk signals from our payment processor.
  • Analytics Providers: Aggregated and segmented audience data from analytics platforms.
  • Social Media Platforms: If you interact with us on social media or use a social login, we may receive profile information you have made available, consistent with your platform privacy settings.
  • Publicly Available Sources: Business contact information from public directories or professional networks, for business-to-business purposes only.

2.4 Sensitive Personal Information

We do not intentionally collect “sensitive personal information” as defined under California law (CPRA), including Social Security numbers, financial account credentials, precise geolocation, racial or ethnic origin, religious beliefs, health data, biometric data, or sexual orientation. If you voluntarily provide any such information (for example, accessibility requirements for delivery), we will use it only for the purpose for which it was provided and will not use it for inferring characteristics about you or for targeted advertising. We do not operate any augmented reality or room-visualisation tool that uses your device camera, we do not use facial recognition technology for fraud prevention or for any other purpose, and we do not use voiceprint or voice- analysis technology. We therefore do not collect biometric identifiers or biometric information within the meaning of the Illinois Biometric Information Privacy Act. Where a telephone or video conference is held to discuss a project, we do not record, transcribe or analyse the call unless we have first obtained the consent of every participant.

2.5 Children’s Information

The Website is not directed to children under the age of 13, and we do not knowingly collect Personal Information from children under 13. If we become aware that we have collected Personal Information from a child under 13 without verified parental consent, we will work to delete that information promptly. If you believe we may have Personal Information about a child under 13, please contact us at privacy@dekercoet.com. We comply with the Children’s Online Privacy Protection Act (COPPA), 15 U.S.C. § 6501 et seq. We also acknowledge the obligations imposed by California’s Age-Appropriate Design Code Act (AB 2273, effective July 1, 2024), which extends protections to minors under the age of 18 for online services likely to be accessed by children, to the extent applicable to the Website.

3. HOW WE USE YOUR INFORMATION

We use Personal Information we collect for the following purposes:

3.1 To Fulfill Your Orders and Provide Our Services

  • Processing, fulfilling, and shipping orders, including custom and bespoke furniture orders.
  • Scheduling and coordinating delivery appointments, including white-glove and in-room delivery.
  • Processing payments and issuing refunds.
  • Creating and managing your customer account.
  • Handling returns, warranty claims, and after-sales service requests.

3.2 To Communicate with You

  • Sending order confirmations, shipping notifications, delivery scheduling information, and invoices.
  • Responding to your inquiries, support requests, and complaints.
  • Sending marketing emails, promotions, and new product announcements — only where you have opted in or where permitted by applicable law.
  • Sending SMS or text messages for delivery coordination or marketing — only with your prior express written consent as required by the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227.

3.3 To Operate and Improve Our Business

  • Analyzing website usage and customer behavior to improve site functionality, product offerings, and customer experience.
  • Conducting internal audits, research, and analytics.
  • Detecting, investigating, and preventing fraudulent transactions, return abuse, chargebacks, and security incidents.
  • Enforcing our Terms and Conditions of Sale and other legal agreements.
  • Complying with applicable legal obligations, court orders, and regulatory requirements.

3.4 For Marketing and Advertising

  • Sending direct marketing communications where you have provided consent or where a prior customer relationship exists and opt-out has not been exercised.
  • Displaying targeted or interest-based advertising on third-party platforms using cookie-derived data, where permitted.
  • Measuring the effectiveness of our marketing campaigns.
  • You may opt out of marketing emails at any time by clicking “Unsubscribe” in any email, or by contacting us at privacy@dekercoet.com. You may opt out of SMS marketing by replying STOP to any message. We strive to honor all opt-out requests within ten (10) business days, and no later than required by applicable law.

3.5 To support AI-enabled features and automated processing

  • Using artificial intelligence (“AI”) powered tools and automated technologies to enhance website functionality and user experience.
  • Providing product recommendations, personalized content, and interactive features based on user activity and preferences.
  • Enabling chatbots, virtual assistants, customer support tools and similar website features that do not use your device camera.
  • Analyzing website usage, customer interactions, trends, and performance metrics to improve our products, services, marketing, and operations.
  • Detecting security incidents, preventing fraud, debugging errors, and maintaining the safety and integrity of our website and services.

4. EEA PRIVACY RIGHTS; LEGAL BASES FOR PROCESSING

This section applies to the extent required by applicable law, including with respect to individuals in the European Economic Area (EEA), United Kingdom, or other jurisdictions whose laws require identification of a legal basis for processing. To the extent applicable law requires identification of a legal basis for processing your Personal Information, we rely on the following:

  • Contract performance: Processing necessary to fulfill your orders, deliver products, process payments, and manage your account.
  • Legitimate interests: Fraud prevention, security, improving our products and services, enforcing our legal rights, and direct marketing to existing customers (subject to your right to object).
  • Legal obligation: Compliance with applicable tax, accounting, consumer protection, and regulatory requirements.
  • Consent: Marketing communications to new subscribers, use of non-essential cookies, and SMS/text messaging. You may withdraw consent at any time without affecting the lawfulness of prior processing.

Additionally, under certain circumstances, individuals within the EEA have rights under data protection laws in relation to your Personal Information as set out below:

  • Request access to your Personal Information (commonly known as a “data subject access request”). This enables you to receive a copy of the Personal Information we hold about you and to check that we are lawfully processing it.
  • Request correction of the Personal Information that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
  • Request erasure of your Personal Information. This enables you to ask us to delete or remove Personal Information where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your Personal Information where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your Personal Information to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
  • Object to processing of your Personal Information where we are relying on a legitimate interest (orthose of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your Personal Information for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
  • Request restriction of processing of your Personal Information. This enables you to ask us to suspend the processing of your Personal Information in the following scenarios: (a) if you want us to establish the data’s accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.
  • Request the transfer of your Personal Information to you or to a third party. We will provide to you or a third party you have chosen, your Personal Information in a structured, commonly used, machine- readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

For all Personal Information that we collect about you, you may have the following rights or choices that we will accommodate where your requests meet legal and regulatory requirements and do not risk making our other data less secure or changing our other data. You may also designate an authorized agent to make a request on your behalf.

Access: You may have the right to know what information is being collected about you, to access your Personal Information, to receive a copy of your information, and to know whether your Personal Information is disclosed and to whom. Erase: You also may request that we erase your information. If you want to ask us to erase your information, please contact us using the methods in the Contact Us section below.

Data Portability: You may have the right to ask for a copy of the Personal Information we have about you. If you would like to request that we provide a copy of your information to you, please contact us using the methods in the Contact Us section below.

Non-Discrimination: You have the right not to receive discriminatory treatment by DE KERCOET because you exercise your privacy rights. If you have any questions, please contact us using the methods in the Contact Us section below.

How to Make a Request: If you would like to make a request, please use the Contact Us section at the bottom of this page. Please provide your full name, phone number, and email address.

Responding to Requests: Your request will be evaluated to determine whether the requested change meets legal regulatory requirements and does not risk making our other data less secure or changing our other data. After we evaluate your request, we will respond to update you on the status of your request.

Verifying Your Identity: To protect you and your information, we may ask you to confirm certain information before we honor your request. For example, if you make a request, we will ask you to confirm your name, email address, and/or phone number verify your identity, so that we can help protect your information. If you designate an authorized agent to make a request on your behalf, we may require you to verify your identity and provide the authorized agent’s identity and contact information to us.

6. HOW WE SHARE YOUR INFORMATION

We do not sell, and have not sold in the past twelve (12) months, any Personal Information, including children’s Personal Information, or any personal information as defined under the CCPA/CPRA. We share Personal Information only as described below:

6.1 Service Providers

We share Personal Information with trusted third-party service providers who process data on our behalf and are contractually bound to use it only for specified purposes and to maintain appropriate security. All service providers act as data processors under our instructions and are prohibited from using Personal Information for their own independent purposes. Where any supplier or service provider uses Personal Information for purposes beyond fulfilling our instructions, they act as an independent data controller and we will disclose that relationship separately in this Privacy Policy or obtain your consent as required by applicable law. The service providers with which we may share your Personal Information include the following:

  • Payment processors (for transaction processing and fraud prevention).
  • Logistics and delivery carriers (for shipping and white-glove delivery coordination).
  • Cloud hosting and data storage providers.
  • Email service providers (for transactional and marketing emails).
  • Analytics and website optimization platforms.
  • Customer relationship management (CRM) software providers.
  • Legal, accounting, and professional advisors.
  • Manufacturing and fulfillment suppliers (for production of furniture, custom and bespoke order fulfillment, and quality control — acting as data processors on our instructions only; see Section 6.2 below).

6.2 Affiliates, Parent Company, and Group Entities

DE KERCOET, Inc. is the U.S. operating entity of the DE KERCOET Group. We share Personal Information with our parent company, DE KERCOET SARL (a French limited liability company registered in Paris, France), and any current or future subsidiaries or affiliated entities within the DE KERCOET corporate group (collectively, “Group Entities”) for the following purposes:

  • Order processing and fulfillment: transmitting order details, custom specifications, and delivery requirements to Group Entities involved in manufacturing, logistics coordination, or customer support.
  • Business operations and reporting: sharing aggregated and individual customer data for group-level financial reporting, compliance, audit, and business planning purposes.
  • IT and systems support: where Group Entities provide shared technology infrastructure, CRM platforms, or IT support services used across the group.
  • Marketing coordination: where Group Entities assist in the delivery of marketing campaigns, provided that any such sharing complies with applicable opt-in and opt-out requirements and is subject to the same restrictions as apply to third-party service providers.

All Group Entities that receive Personal Information are bound by data processing agreements or intra-group data transfer agreements that impose obligations equivalent to those set out in this Privacy Policy. Where Personal Information is transferred from EEA-based Group Entities (including DE KERCOET SARL in France) to DE KERCOET, Inc. in the United States, such transfers are conducted under Standard Contractual Clauses approved by the European Commission, or another lawful transfer mechanism. See Section 13 (International Data Transfers) for further details.

6.3 Business Transfers

If DE KERCOET, Inc. is involved in a merger, acquisition, asset sale, restructuring, or bankruptcy, your Personal Information may be transferred as part of that transaction.

6.4 Legal and Safety Disclosures

We may disclose Personal Information when required or permitted by law, including to: (i) comply with a subpoena, court order, or other legal process; (ii) respond to requests from law enforcement agencies or government authorities; (iii) protect our rights, property, or safety, our customers, or the public; or (iv) investigate fraud, security breaches, or other violations of our policies.

6.5 With Your Consent

We may share your Personal Information with third parties for purposes not described in this Privacy Policy where we have obtained your prior express consent.

6.6 Do Not Sell or Share — California

We do not sell personal information as defined under the CCPA/CPRA. We also do not currently share personal information with advertising partners for cross-context behavioural advertising, which would constitute “sharing” under California law. If we enable advertising or targeting technologies in the future we will update this Privacy Policy and make an opt-out mechanism available before doing so. Residents of states that provide an opt-out right may in any event submit a request to privacy@dekercoet.com, and we honour recognised universal opt-out signals, including Global Privacy Control, transmitted by your browser. We will act on sucha request within fifteen (15) business days.

7. DATA RETENTION

We retain Personal Information for as long as necessary to fulfill the purposes for which it was collected, or as required by applicable law.

8. COOKIES AND TRACKING TECHNOLOGIES

We use cookies, pixel tags, web beacons, and similar tracking technologies on our Website. Cookies are small data files placed on your device. We use the following categories of cookies:

Strictly Necessary Cookies

Required for the Website to function (e.g., shopping cart, secure login, fraud prevention). These cookies cannot be disabled without significantly impairing website functionality. No consent is required for these cookies.

Functional Cookies

Enable enhanced features such as remembering your language preference, delivery address, or recently viewed items. These cookies are set by us or by third-party providers whose services we have added to our pages.

Analytics Cookies

Allow us to count visits and traffic sources so we can measure and improve the performance of our site. All information collected is aggregated and therefore anonymous. If you do not allow these cookies we will not know when you have visited our site.

Advertising / Targeting Cookies

Set by our advertising partners to build a profile of your interests and show you relevant advertisements on other sites. They work by uniquely identifying your browser and device. 9. DATA SECURITY

We implement and maintain reasonable technical and organizational security measures designed to protect your Personal Information against unauthorized access, disclosure, alteration, or destruction.

Notwithstanding the above, no method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your Personal Information, we cannot guarantee absolute security. In the event of a data breach that is likely to harm your rights or interests, we will notify you and applicable regulatory authorities as required by applicable law, including applicable state breach notification laws.

All U.S. Residents — Breach Notification: We make best efforts to comply with all applicable state data breach notification laws. All 50 states and the District of Columbia have enacted breach notification requirements with varying timelines (generally ranging from 30 to 90 days), content requirements, and notification thresholds. In the event of a breach of your Personal Information, we will notify you and any required regulatory authorities within the timeframe mandated by the law of your state of residence, and in no event later than the most restrictive applicable deadline. We maintain a data security program covering administrative, technical, and physical safeguards consistent with applicable state requirements.

The Website may contain links to other third-party sites on the Internet. The information practices of those websites are not covered by this Privacy Notice. We are not responsible for the privacy policies of other websites.

10. YOUR PRIVACY RIGHTS

Depending on your state of residence, you may have rights regarding your Personal Information, including the right to access, correct, delete, and obtain a portable copy of your information; to opt out of the sale of Personal Information (where applicable); to opt out of targeted advertising and certain profiling that produces legal or similarly significant effects; to limit the use of sensitive personal information (where applicable); and to appeal a denied request. We honor these rights as required by law. You may authorize an agent to submit a request on your behalf where your state permits it; we will verify both you and your agent as required.

For California residents, these rights include those set out in the California Consumer Privacy Act, as amended by the CPRA, including the right to limit certain uses of sensitive personal information and the ability to opt out of cross‑context behavioral advertising. We do not currently offer any financial incentive programs in exchange for Personal Information.

All U.S. residents benefit from the following federal privacy protections:

  • CAN-SPAM ActYou may opt out of commercial email communications at any time by clicking “Unsubscribe” or by contacting us directly.
  • TCPA: We will not send you marketing SMS/text messages without your prior express written consent. You may withdraw consent at any time by replying STOP.
  • Fair Credit Reporting Act (FCRA): To the extent we use consumer report information, we comply with FCRA requirements.
  • FTC Act: We do not engage in deceptive or unfair trade practices in connection with the collection or use of Personal Information.

11. AUTOMATED DECISION-MAKING AND PROFILING

We use automated processing of Personal Information, including product recommendations, on-site personalisation, chatbot and virtual assistant tools, fraud and payment-risk scoring, and website analytics and optimisation. None of this processing produces legal or similarly significant effects for you: we do not use automated processing to make decisions about credit, employment, housing, insurance or access to essential goods or services. Where such processing would produce legal or similarly significant effects, residents of applicable states have the right to opt out. 12. HOW TO EXERCISE YOUR PRIVACY RIGHTS

You may submit a privacy rights request by any of the following methods:

To protect your privacy, we must be able to verify your identity before we can fulfill a request. We will ask you to provide information that matches what we have on file for you (such as your name, email address, and order number). We will not require you to create an account to make a request. Authorized agents must provide a signed permission letter from the consumer and may be required to verify their own identity.We will not use the information you provide in a rights request for any other purpose.

We will work to acknowledge receipt of your request within ten (10) business days and will provide a substantive response within the timeframe required by the applicable state law (typically 45 days, with a possible extension of an additional 45 days). We will not charge a fee for your first two requests in any 12-month period unless they are manifestly unfounded or excessive.

13. INTERNATIONAL DATA TRANSFERS

DE KERCOET, Inc. is a U.S. company and processes Personal Information primarily in the United States. As part of our ordinary business operations, we also transfer certain Personal Information to our parent company, DE KERCOET SARL, located in Paris, France (an EU jurisdiction), and to other Group Entities and manufacturing suppliers that may be located outside the United States. If you are accessing the Website or purchasing from outside the United States, please be aware that your Personal Information will be transferred to and processed in the United States and potentially in France or other countries, where privacy laws may differ from those in your home country.

14. THIRD-PARTY WEBSITES AND LINKS

Our Website may contain links to third-party websites, social media platforms, and other online services. This Privacy Policy does not apply to those third-party sites, and we are not responsible for their privacy practices.

We encourage you to review the privacy policy of every website you visit. The inclusion of a link on our Website does not constitute endorsement of that third party’s privacy practices.

15. DO NOT TRACK SIGNALS

Some browsers transmit “Do Not Track” (DNT) signals to websites. Because there is currently no industry standard for how websites should respond to DNT signals, our Website does not currently respond to DNT signals. We will revisit this policy as industry standards develop.

16. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will notify you by: (i) posting the updated Privacy Policy on our Website with a revised effective date; and (ii) where required by applicable law, sending you an email notification or displaying a prominent notice on our Website at least 30 days before the changes take effect. Your continued use of our Website or services after the effective date of any changes constitutes your acceptance of the updated Privacy Policy.

The version of this Privacy Policy that was in effect at the time you provided your Personal Information governs our use of that information. We maintain an archive of prior versions of this Privacy Policy, which is available upon request.

17. PRIVACY DISPUTE RESOLUTION

We take all privacy concerns seriously and are committed to resolving them promptly. If you have a concern about our privacy practices, please follow the process below:

Step 1 – Initial Contact. Contact our Privacy Officer at privacy@dekercoet.com or by mail at DE KERCOET, Inc., 1441 Brickell Avenue, Suite 1510, Miami, Florida 33131, Attention: Privacy Officer. We will use best efforts to acknowledge your complaint within ten (10) business days and provide a substantive response within thirty (30) days.

Step 2 – Escalation. If you are not satisfied with our initial response, you may escalate your concern to a senior member of our legal or compliance team by requesting escalation in writing. We will respond to escalated complaints within fifteen (15) additional business days.

Step 3 – Regulatory Complaints. If you remain unsatisfied, you may lodge a complaint with the applicable state Attorney General or consumer protection agency, as described in the relevant state-specific rights section above. For EEA or UK residents, you may lodge a complaint with the relevant supervisory authority (for France, the CNIL; for the UK, the ICO).

Arbitration. Any dispute, claim, or controversy arising out of or relating to this Privacy Policy or our collection, use, disclosure, or security of Personal Information will be resolved by binding, individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect (available at www.adr.org). The arbitration shall take place in Wilmington, Delaware, unless the parties mutually agree otherwise or applicable law requires a different location. For claims of $10,000 or less, the consumer may elect to proceed via telephone, video conference, or written submission. The arbitrator may award any remedy a court could award, on an individual basis only. Arbitration fees will be allocated according to the AAA Consumer Arbitration Rules.
